DWI

Finding yourself charged with Driving While Impaired (DWI) or Driving Under the Influence (DUI), is a frightening reality. The attorneys in the office of Butch Williams have years of experience providing representation to those facing this serious charge.

The law in North Carolina requires one’s license to be revoked for a year or longer, if convicted. However, having an attorney to help you during this process can improve your legal outcome.

While DWI is a serious matter to face, we can help navigate you through the legal process. This charge does not have to end your career or ruin your life.

Expungement

Having a conviction on your record for the rest of your life has collateral consequences that can make your life difficult. For example, when you apply for jobs, housing, or other assistance there is usually a box you are required to check indicating whether you have a criminal record. You may not be selected if you have been convicted of a crime, and your conviction may negatively impact the final decision.

Obtaining an attorney to help with an expungement may be able to erase traces of past offenses from your record. Once cleared, background checks will not be able to see your prior conviction and you will not be required to disclose having a criminal record.

However, North Carolina expungement statutes are narrow and restrict what convictions may be erased. Your lawyer will be able to guide you through the process, determine whether you may qualify to receive an expungement and file the appropriate forms to clear your record.

Federal Criminal Defense

If you are charged with federal offense, you will need assistance. Attorney Williams and his legal team can represent you in this difficult time. Federal charges are brought by the United States Department of Justice and are investigated by federal agencies like the FBI and ATF.

Federal charges are generally much more serious and carry harsher sentences. Crimes that violate federal laws and are seen as more of an offense and threat to the entire nation are tried in federal court. These include things like the trafficking of sex, drugs, or weapons, terrorism, money laundering, espionage, kidnapping, and bank robbery.

Facing serious charges and federal prosecution means you are fighting an uphill battle. You will need a skillful attorney, who will fight for your best outcome. Attorney Williams and his experienced legal team will represent you if you are charged with a federal offense.

Felonies

Felonies are the most serious crimes you can be charged with in the state of North Carolina. If you are facing a felony charge, you are certainly going to need expert legal help to ensure your best possible outcome. The Law Offices of James D. Williams, Jr., P.A. can navigate you through the difficult experience of facing serious felony charges.

Negotiations with felonies require structured sentencing and range from minimum of parole to a maximum of the death penalty.

In North Carolina, whether you’re in Durham, Raleigh, the coast, or the mountains, the same structured sentencing applies. There are different levels of felonies, with different sentencing based on this structure of classes of A through I. Class A felonies are the most serious, with a maximum penalty of death or life in prison. There are only two crimes that are Class A, though – first degree murder, and unlawful use of weapons of mass destruction.

Negotiation with prosecutors and considerations of prior records also come into play. If you are being charged with a felony in North Carolina, trust Attorney Williams and his expert team to stand in your corner.

License Restoration

According to North Carolina law, having a driver’s license is a privilege granted by the DMV. In modern society, driving feels more like a necessity than a privilege. People need an automobile to get to work, to run errands, and to live their daily lives.

HAVING YOUR LICENSE SUSPENDED

At times, the courts or the DMV will determine that this privilege should be suspended or revoked. This can happen for a number of reasons, including DWI convictions or refusal to submit to a breathalyzer. For a first offense, DWIs or refusals to blow require the license be suspended for a year.

If you fail to appear for a court date or fail to pay a court fine, the judge may order your license suspended. If you fail to pay child support, your license can be suspended until the full amount is paid. Many driving offenses may lead to a suspension or revocation of license, including but not limited to, reckless driving, speeding, accruing points on your license, and failure to pay parking or speeding tickets can all lead to loss of your license.

CAN THESE PRIVILEGES BE RESTORED?

Licenses that are suspended, can be restored in many circumstances. Having an attorney who understands the statutes in this area and can apply it to your specific case will give you the best chance of regaining your driving privileges.

Our attorneys are experienced in determining the best course of action to pursue. This could be seeking a deal with the District Attorney to have the sentence suspended, a prayer for judgement granted, the charge dismissed, or pleading guilty to a lesser charge. There are times when one can have limited driving privileges restored to go to work or for other necessary functions. Our legal team will pursue the most appropriate time to weigh these options.

A DMV HEARING

Driving is a privilege granted by the DMV, having your license restored is not done through a criminal court but through a hearing with the DMV. While this hearing is not open to the public, you are permitted to have an attorney represent you in front of the hearing officer. These proceedings are similar to court cases, and you should rely on expert legal counsel to make sure you get the best representation and the best chance at restoring your driving privileges.

Misdemeanors

While you may think being charged with a misdemeanor is not a serious matter, it is. Charges like marijuana possession, theft, and vandalism are common misdemeanors. Do not face a misdemeanor charge alone. If you are charged with a misdemeanor, contact our office. Our team will come up with the best strategy for your defense and can give you a fighting chance.

Traffic Offenses

Traffic offenses have become more common. Some traffic offenses simply involve fines, but others are misdemeanors that can affect your criminal record.

Being charged with traffic offenses can also add points to your license and criminal charges to your record. We will help ensure the best outcome possible.

Everyone makes mistakes while driving, do not let an innocent mistake tarnish your record, increase your automobile insurance, or leave you with expensive tickets.

Underage Alcohol Offenses

Drinking alcohol is illegal for anyone under the age of 21 in all 50 states of the United States, including North Carolina. However, the reality is alcohol is a part of youth culture on many college campuses and even in high schools. Underage drinking can lead to thousands of arrests and citations.

If you or a loved one are facing a criminal charge for underage alcohol possession, consumption, or for providing alcohol to a minor, legal representation is essential. Our legal team can guide you through the process and work towards minimizing or eliminating the impact of the charge.
